Estate & Tax Planning

We create documents ranging from simple wills and powers of attorney to complex trusts. However, the documents themselves are only one part of a complete estate plan. Let’s meet to explore how inheritance taxes, estate taxes, capital gains taxes, charitable giving strategies, the elective share, retirement account distribution rules and other factors could impact your family and plan – and figure out how we can best address relevant concerns.

Administration & Probate

We help clients navigate the legal process related to the death of a loved one. From analyzing documents to helping you understand your rights and responsibilities, we represent clients seeking to be appointed as the executor or administrator (when someone dies without a will) of an estate, acting in an advisory role to help minimize costs while empowering and supporting you in the process of bringing outstanding issues to an ethical and amicable conclusion. 

Estate Litigation

We can help you take action to stop a will from being probated (“filing a caveat”), initiate a complaint to compel others to take action, or respond to a claim that has already been filed. Litigation can be an intense, emotional, and time consuming experience but we will do our best to keep you informed and in control throughout the process. These matters can be very time-sensitive so don’t delay in seeking out advice as soon as possible. 

Special Needs Planning

We’d love to help explain how special needs trust work to see whether a first or third party special needs trust might be appropriate for your situation or loved one. We strongly recommend planning ahead and protecting assets for a disabled person BEFORE a gift or bequest is made. 

Elder Law Planning

We can help you objectively compare and evaluate various trust and giving strategies. However, please note that we do not specialize in and will not assist with last minute asset protection planning or medicaid-compliant annuities.

Guardianship

Laws exist to help protect the mentally and physically incapacitated from exploitation and abuse. If your loved cannot make good decisions about their affairs, we’d be happy to help you analyze their lifetime estate planning documents (if any) and see what legal steps you could take to step up and in for them.
